Via sicura with employer liability

Who is liable if an employee has caused an accident with the company car?


As part of the "Via sicura" program, the Road Traffic Act was changed. It now requires insurance to take recourse against the insured or the policyholder. This in the following cases:

  • Driving in a drunken / unfit to drive state
  • caused by massive speed offense

Recourse cannot be entirely ruled out to the insurance contract anymore. Thus, it can also meet the employer as the policyholder of the business vehicle.

The employer may hold himself at least partially harmless with a right of recourse to the employees.
